Child Support on Retirement Income

Retiring does not end a child support obligation. Pensions, 401(k)/IRA distributions, annuity payments, and Social Security retirement benefits are generally counted as income in the guideline calculation. The one special rule: Social Security dependent benefits paid directly to the child can be credited against the obligation in most states.

The SSDI / retirement credit

If a child receives Social Security (retirement or disability) dependent benefits because of the paying parent, nearly every state credits those benefits dollar-for-dollar (or nearly so) against the support obligation. That credit alone can reduce or eliminate the payment — document the benefit award letter and bring it to the hearing.

Retirement is a changed circumstance: if the guideline recalculates to a materially different number than your order, you can request modification. Same threshold test as any income change.
