New York uses the Child Support Standards Act (CSSA): a flat percentage of COMBINED parental income (17% / 25% / 29% / 31% / 35% for 1-5+ children), capped at the statutory combined-income cap of $193,000/year (effective March 1, 2026, raised from $183,000). Each parent pays their proportional share; add-ons (childcare, unreimbursed medical, education) are shared proportionally. Income above the cap is discretionary.

Worked examples

Illustrative example - combined $96,000/yr, 2 children, 60% obligor — Combined parental income $96,000/year (below the $193,000 cap); two children; obligor earns 60%. Basic obligation = 25% x $96,000 = $24,000/year = $2,000/month. Obligor pays 60% = $14,400/year ($1,200/month). Add-ons split 60/40 on top. The flat CSSA percentage makes New York\'s basic obligation straightforward up to the cap; only above-cap income requires judicial discretion.

Modifying or enforcing an order

Orders in New York can be modified when there is a substantial change in income, custody, or circumstances. Use the modification eligibility check and the cross-state comparison tool to see how a move would change the outcome. Enforcement runs through the state agency and can include income withholding and contempt proceedings.
